Italian Design
The purpose of filing an application for a design registration, according to the provisions of the national legislation in force, is to protect the appearance of the whole or a part of a product as it results, in particular, from the features of the lines, contours, colours, shape, surface texture and/or materials of the product itself and/or its ornamentation.
The registration of a design confers on the holder the exclusive right to use it (to manufacture, offer, market, import, export) and to prohibit third parties from using it without his consent. These rights extend to any design that produces the same general impression on the informed user.
A design registration is valid until proven otherwise, which can be provided by an interested third party at any time. Design registration lasts five years from the date of filing of the application; the holder may request an extension of the duration for further periods of five years up to a maximum duration of 25 years from the date of filing of the application.
An application for registration must contain one or more images of the product to be protected, which may consist of photographs or sufficiently detailed drawings, possibly accompanied by a brief description of the product. Several designs may be applied for by filing a single application, provided that they relate to products with common and homogeneous aesthetic features.
