The filing of an International Trade Mark application can be done by designating one or more of the countries that are members of the Madrid System. The so-called Madrid System is the amalgamation of two different conventions (Madrid Agreement and Madrid Protocol) and the countries that signed them. 



The international filing, which must be preceded by the filing of a national trade mark application in one of the member countries of the Agreement or of the Protocol, is in force as an alternative to the various national filings, and is effective in all the countries designated at the time the application is filed, and in any countries designated after the filing of the application (with different time durations of the design rights).

The International trademark thus generates a package of national marks in the designated countries, with a duration of ten years, renewable indefinitely. The possibility of designating different countries depends on the convention to which the country of origin of the national trade mark application adheres. 




Italy has signed both the Agreement and the Madrid Protocol and it is therefore possible, starting with a national registration, to extend the protection of the Italian trademark to all the countries that are members of the Madrid System, designating both the countries that are members of the Agreement and those that are members of the Madrid Protocol.
