The registration of a Community trade mark provides exclusive protection for goods and/or services belonging to the classes of goods indicated at the time of filing.


All new signs that are capable of being represented graphically, provided that they are capable of distinguishing the goods and/or services of one undertaking from those of other undertakings, may be the subject of registration as a Community trade mark


Signs that may constitute a trade mark may consist of words, designs, letters, numerals, sounds, shape of the product or its packaging, colour combinations and shades, etc. 


The trade mark must fulfil the basic requirements of novelty, originality and distinctiveness.

Registering the Community Trade Mark

In order to apply for a CTM registration, the trade mark must be new. 


A trade mark is new if it is not confusable with earlier identical or otherwise confusable signs used by others as a trade mark, firm or sign for identical and/or similar goods and/or services. A trade mark is distinctive if it is capable of making the distinguished goods and/or services recognisable in a clear and obvious manner in comparison with identical and/or similar goods and/or services on the market. 


The trade mark is original if it does not consist of a generic and descriptive indication of the goods and/or services distinguished. Furthermore, the mark must not be such as to deceive consumers as to the origin and quality of the marked goods and/or services.
