Filing a trade mark application with the U.I.B.M. (Italian Patent and Trade Mark Office) grants the applicant the right to exclusive use in Italy (production, marketing, importation) of the trade mark for the goods and/or services indicated in the application. A trade mark registration has a duration of 10 years from the filing date, renewable indefinitely.


The U.I.B.M. carries out only a formal examination of the filed application, without conducting a substantive examination, i.e. it does not carry out a prior art search or an examination of novelty, in order to assess the presence of the registrability requirements. 



After the formal evaluation, the U.I.B.M. publishes the trade mark in the Trade Marks Gazette and within 3 months from the date of publication any third party may oppose the registration of the trade mark by filing an opposition request on which the office will decide. 



If the opposition is not filed or is rejected, the trade mark is registered. After 5 years from the registration date, the trade mark is consolidated and can no longer be challenged.
